THIRD PARTY CLAIMS
We specialise in third party claims and mva damages claims. Our Mr. Theron has been specialising in this field since 1998 and developed a database system with IT specialists in order to improve the availability of information to both in house personnel and clients through a web based platform. This improves substantially on the reaction time related to client queries.
We believe that it is important to challenge the decisions of the Road Accident Fund in settlement of any third party claim, as we had found that without the input and determination of the acting attorneys, the Road Accident Fund will under settle most of the claims. In this regard we believe that the best way to tackle the Road Accident Fund and the system is to enter into strict negotiations on settlements and should the Fund not be willing to offer a reasonable settlement for a claim, we proceed to issue summons on each and every such claim.
We have an exceptional track record on successful claims, as we scrutinise each claim in order to validate the claim and to confirm that it has a very good chance of success. Through the many years of experience we have learned a lot regarding the processes of the Road Accident Fund and the needs of the clients.
Most of our clients are referred to us by merit investigators who received instructions from motor vehicle accident victims to investigate the merits of their accidents. After receiving instructions from the client through the referral of these firms we work closely together with the merit investigators in order to insure that a proper investigated claim is lodged with the Road Accident Fund to insure the successful finalisation of the claim.
We also proud ourselves in the fact that we assist a great number of underprivileged people in rural areas who would have not been able to claim against the Road Accident Fund, was it not for the assistance of the merit investigators as well as the expertise and professional work done by ourselves. In this regard we assist these clients to obtain specialized medical reports critically needed for a successful claim, for which we arrange financing, as well as all the expenses incurred in relation to the administering of a successful third party claim.
In order to do this we have negotiated a finance product in order to finance the expenses of such a claim with an institution that is willing to grant a loan without receiving any kind of security on the loan amount from the client. We also provide our services on a risk basis, in other words we will proceed with the administering of the third party claim until it is finalised and only on the successful payment of a claim do we take a success fee, which is usually 25% of the capital of the claim.
We strive to become more and more client friendly and are very sensitive to the needs of our clients. In this regard our data base system on the internet (click on Client Portal to log in) where every MVA claimant may enter his surname and file number, will inform him/her of the progress of his claim. This is a much more user friendly and cost effective manner of informing clients of the progress of their claims, than the traditional telephone call or letters written. In addition to this we also forward an informative letter and sms for several stages of the claim to the client, to inform them of the next stage being entered into.
We believe that any claimant, who lodges a claim through our firm, will have the benefits of obtaining a reasonable settlement from the Fund and having their expenses paid for them until the claim is finalised.
